Terms and Conditions of our service

The following General Terms and Conditions of Sale govern the offer and sale of products on this website: www.wildandinspire.com (hereafter, the "Site"). The Site features hand-assembled products created and sold by Cappon Mauro, based in Frazione Rivalta Rossi 30, 12064 La Morra (CN), VAT code: 04204040044, REA: CN-343530. Register of Artisans: CN-106546, email: info@wildandinspire.com (hereafter, “Owner”).
1. Scope of application
1.1 The sale of products through the Site (Products) constitutes contract at distance governed by Chapter I, Title III (articles 45 et seq.) of Legislative Decree no. 206 of 6 September 2005 (Consumer Code) and by Legislative Decree no. 70 of 9 April 2003.
1.2 The General Terms and Conditions of Sale may be modified at any time. Any changes and/or new conditions will be effective upon their publication on the Site. Therefore, before making any purchase, users are required to review the General Terms and Conditions of Sale.
1.3 These General Terms and Conditions of Sale do not govern the sale of products and/or the provision of services by parties other than the Owner who are present on the Site via links, banners, or other hypertext links. Before conducting commercial transactions with these parties, it is necessary to verify their terms and conditions of sale. The Owner is not responsible for the provision of services and/or the sale of products by these parties. The Owner does not carry out any control and/or monitoring of the websites accessible via these links. The Owner is therefore not responsible for the content of these sites or for any errors and/or omissions and/or violations of law by them.
2. Purchases on the Site
2.1 Access to the offers on the Site is reserved exclusively for users who are 18 years of age or older.
2.2 Access to the offers on the Site is permitted only to users who are consumers, following Article 3, paragraph I, letter a) of the Consumer Code. Professionals, retailers, wholesalers, or, in general, anyone intending to purchase Products for resale may not make purchases on the Site. Therefore, such individuals are prohibited from making purchases on the Site. Interested parties may email us at info@wildandinspire.com and will be contacted.
2.3 The Owner reserves the right to refuse or cancel orders from (i) a user with whom it has an ongoing legal dispute; (ii) a user who has previously violated these General Terms and Conditions of Sale and/or the terms and/or conditions of a purchase contract; (iii) a user who has been involved in fraud of any kind, particularly credit card fraud; (iv) users who have provided false, incomplete, or otherwise inaccurate identification data; (v) users who are not consumers pursuant to Article 3, paragraph 1, letter a) of the Consumer Code.
3. Registration on the site
3.1 Purchase of Products is permitted in Guest Mode. No registration is required.
4. Information on the purchasing process
4.1 To purchase one or more Products on the Site, the user must add them to the cart. Before proceeding to Checkout the user must read the general conditions of sale and the information on the processing of personal data. After accepting these conditions, the user can access and complete the order form in electronic format by entering all the necessary data requested and transmit it electronically to the seller, following the instructions that will appear from time to time on the Site and which will accompany the various stages of the purchase.
5. Conclusion of the contract
5.1 The Owner will notify the buyer of receipt of the order by sending a receipt message containing information relating to the product(s) purchased; the price, payment method, delivery and billing information, shipping costs, processing times and general conditions of sale, information on shipping terms, refunds and returns.
5.2 The contract is deemed concluded with production, at the place (the Owner's headquarters) and at the time of delivery of the goods to the courier.
5.3 Any order confirmations are to be considered simple notices that production of the purchased product(s) has begun.
5.4 The buyer is required to download from the website www.wildandinspire.com and print or save on a durable medium a copy of these general conditions of sale, without prejudice to the seller's right to send, independently, a copy to the buyer.
6. Validity of offers and prices
6.1 All Product prices are expressed in Euros (€). Any additional costs will be separately indicated in the order form before the buyer proceeds with the submission of the order.
6.2 The Owner may change the price of the Products at any time, without notice, provided that the price charged to the user will be the one published at the time the order is placed. Any price changes (increases or decreases) subsequent to the order being placed will not be taken into account.
6.3 Products may be offered for sale on the Site at discounted prices.
6.4 On the Site it is possible to request a customization operation for some product categories.
7. Purchase Orders - Product Information
7.1 The products offered on the Site are hand-assembled using artisanal methods and created to order. Processing times vary depending on the product chosen, generally between 7 and 10 business days and 10-15 business days for custom and/or customized products.
7.2 The Owner will begin hand-assembling the purchased product(s) only after receiving confirmation of authorization for payment of the total amount due. If payment is not confirmed or is unsuccessful, the purchase contract will be deemed automatically terminated pursuant to and for the purposes of Article 1456 of the Consumer Code. The user will be notified of this termination and the resulting cancellation of the order immediately after placing the order, by email.
7.3 All products offered on the Site are hand-assembled using artisanal methods, not mass-produced but only in limited runs. Therefore, they may present small manufacturing imperfections. These small imperfections and defects should be considered a guarantee of the product's craftsmanship and do not constitute any right to a refund/compensation/replacement under warranty unless they affect the item's appearance and/or functionality.
7.4 The Owner undertakes to describe and present the products on the Site as accurately as possible. However, some errors, inaccuracies, or small differences between the product depicted and the actual product may occur, also due to the natural differences in size and/or colour of natural stones. Furthermore, the colours in the product photographs may vary in tone depending on the device used to view the photo. Therefore, these photographs do not constitute a contractual element, as they are merely representative.
7.5 The Products will remain the property of the Owner until they’ve been delivered to the courier responsible for the shipment.
7.6 All our products are not suitable for children under 14 years of age.
8. Product Availability
8.1 The products offered on the Site are not immediately available; they are all hand-assembled using artisanal methods and are therefore created only to order, as indicated in point 6.1 of this policy.
8.2 In any case of unavailability of the materials required to produce the ordered product, the customer will be promptly notified by email. The Owner will inform the customer of the expected timeframe for purchasing the materials and the processing timeframe. The customer may decide to accept the new conditions or will therefore be entitled to immediately terminate the contract, without prejudice to the right to compensation for damages. If the customer exercises this right and in any case in which payment of the Total Amount Due has already been made, the Owner, without prejudice to the customer's right to compensation for damages, will refund such amount without undue delay and, in any case, within a maximum of 15 business days from the order placement. The refund amount will be the total communicated to the customer via email. This amount will be credited to the same payment method used by the customer for the purchase. Any delays in crediting may depend on the banking institution, the type of credit card, or the payment solution used. In any case, the value date will be the same as the debit date.
8.3 In the case of multiple orders, if the unavailability of the materials required for production concerns only some of the Products included in the Multiple Order, the Owner will immediately notify the customer via email. The Owner will inform the customer of the expected timeframe for purchasing the materials and the expected processing timeframe. The customer may decide to accept the new conditions or will therefore be entitled to immediately terminate the contract, limited to the Product(s) that have become unavailable due to the materials required for production, without prejudice to the right to compensation for damages. If the customer exercises this right, and in any case if payment of the Total Amount Due has already been made, the Owner, without prejudice to the customer 's right to compensation for damages, will refund the amount due for such Product(s), including delivery costs, calculated proportionally to the number of products, and any other additional costs specifically due for such Products (Partial Amount Due) without undue delay and, in any case, within a maximum of 15 working days from the order date. The refund amount will be communicated to the customer via email. This amount will be credited to the same payment method used by the customer for the purchase. Any delays in crediting may depend on the banking institution, the type of credit card, or the payment solution used. In any case, the value date will be the same as the debit date.
9. Delivery of purchased Products
9.1 The customer can choose to collect the goods at the owner’s premises, or choose to have them shipped via courier. This choice can be made when completing the purchase form on the Website.
9.2 The "Collect from Premises" option has no shipping costs or additional fees. After confirming the order, the customer will receive an email with pickup instructions. To collect, a valid ID and the order number are required.
9.3 As indicated in point 6.1 of this information, processing times may vary based on the product chosen. In any case, the Owner undertakes to deliver the goods to the customer without delay and no later than thirty days from the date of conclusion of the contract as provided for by art. 54, paragraph 1 of the Consumer Code.
9.4 Shipping costs are advance payments made by the customer. They may vary depending on the delivery service chosen and are indicated during the purchase process, in the order summary, and before the consumer proceeds to submit the order.
9.5 Delivery times vary approximately from 3 to 10 business days depending on the destination. These times are approximate: a delay of less than thirty days from shipment confirmation does not entitle the customer to refuse delivery. Please note that during holiday periods (e.g., Christmas), delivery times may vary beyond the Owner's control.
9.6 It is the customer's responsibility to verify the condition of the Product delivered or collected. Customers are advised to verify the number of Products received and to ensure that the packaging is intact, undamaged, not wet, or otherwise altered, including the sealing materials. Customers are encouraged, in their own interest, to indicate any anomalies on the carrier's shipping document and accept the package with reservations. If the damage is not apparent upon delivery, it must be reported as soon as it is discovered and no later than eight days after receipt. Customers must notify the Owner of any anomalies, attaching photographs demonstrating the damage to the goods and the exterior of the package.
9.7 The Owner is not liable in any way for any delivery errors resulting from inaccuracies or omissions made by the customer in completing the purchase order, nor for any damage or delays occurring after delivery to the courier if the latter has been appointed by the customer.
If the goods are not delivered or collected at the time or within the agreed upon deadline, they will be returned to the Owner, who will contact the costomer to schedule a second delivery attempt or agree on further arrangements. Unless otherwise specified, each delivery attempt will be at the customer's expense.
9.8 We deliver to Italy and other European countries, including the United Kingdom, Norway, and Switzerland. Please note that shipping to non-EU countries could incur customs fees, which will be paid by the customer.
10. Payment Methods
10.1 Payments on this Site are managed and settled in complete safety by SHOPIFY.
10.2 Accepted payment methods: Credit and debit cards (Visa, Mastercard, Maestro, American Express).
10.3 Payment details are communicated to the SHOPIFY PAYMENTS payment gateways.
10.4 The Owner of Wild and Inspire does not have access to, or view, the data transmitted during payment; he or she receives only technical confirmation of the transaction.
10.5 If payment using one of the available methods fails or is refused by the service provider, the Owner is not obligated to fulfil the order. In such cases, the Owner reserves the right to request reimbursement from the customer for any costs or damages related to the failed transaction.
11. Right of Return and Refund
11.1 The consumer, pursuant to art. 3, paragraph I, letter a) of the Consumer Code, has the right to return an item, therefore to withdraw from the contract concluded with the Owner, without incurring costs other than those indicated in this article and without having to specify the reason, within fourteen (14) calendar days (Withdrawal Period), from the moment in which the consumer or a third party, appointed by the consumer and other than the courier, takes possession of the goods.
11.2 To exercise the right of return, the consumer must send the Owner an appropriate and unequivocal communication of their decision to return the article, and therefore withdraw from the contract, to info@wildandinspire.com before the expiration of the Withdrawal Period. Since the burden of proof relating to the exercise of the right of withdrawal before the expiration of the Withdrawal Period falls on the consumer, it is in the consumer's best interest to use a durable medium (email) when communicating their withdrawal to the Owner.
11.3 After exercising the right to return an article as described in these Terms and conditions, the consumer will be contacted by the Owner who will provide instructions for returning the Product. The consumer is responsible for the direct costs of returning the Product. Returning the Product to the Owner is the consumer’s responsibility; the Product is considered returned when it is delivered by the shipping method to the Owner.
11.4 The Owner will proceed with the refund of the Total Amount indicated on the receipt/invoice paid by the customer, only after receiving the returned item and verifying that it is intact and without alterations. Unless otherwise agreed with the customer, the refund will be made using the same payment method used by the user for the initial transaction.
11.5 If the consumer does not exercise your right of return in accordance with applicable law, this will not result in termination of the contract and will not entitle the consumer to any refund. The Owner will notify the consumer of this within 5 business days of receiving the Product, rejecting the request for a return. If the Product has already been received by the Owner, it will remain at the Owner's premises and be available for collection by the consumer, at the consumer's expense and under their own responsibility.
11.6 All products made to measure or clearly personalized are excluded from the right of refundl, pursuant to Article 59 of the Consumer Code.
12. Discount Codes
12.1 Purchases on the Site can also be made using discount codes issued by the Owner.
12.2 Discount codes cannot be combined for a single purchase. Discount codes cannot be used to purchase products already on sale. Discount codes cannot be used for payments lower than their value. Each discount code can only be used for a single purchase. Under no circumstances will discount codes give the right to change for purchases of lower amounts.
12.3 Any products for which discount codes cannot be used will be duly indicated on the Site.
12.4 In the event of cancellation for any reason of an order for which a discount code was used, the total amount paid at the time of order will be credited back to the same payment method used by the user for the purchase. The discount code used cannot be reused.
12.5 Under no circumstances may discount vouchers be converted into cash.
13. Legal Guarantee of Conformity
13.1 All Products sold on the Site are covered by the Legal Guarantee of Conformity pursuant to Articles 128-135 of Legislative Decree No. 128-135 of the Consumer Code (Legal Guarantee).
13.2 The Legal Guarantee is reserved for consumers. Therefore, it applies only to consumers who have made purchases on the Site for purposes other than their business, commercial, artisanal, or professional activities.
13.3 The seller is liable to the consumer for any lack of conformity existing at the time of delivery of the Product and which becomes apparent within two years of such delivery.
13.4 The seller is required to guarantee that the purchased goods have the promised or reasonably foreseeable quality, functionality, or characteristics for at least two years from the time of delivery.
13.5 To benefit from the Legal Guarantee, the consumer must provide proof of the date of purchase and delivery of the goods. For the purposes of this proof, it is advisable for the consumer to keep the purchase invoice or commercial document that the Owner sends them, or any other document that can certify the date of purchase (for example, the credit card statement) and the delivery date.
13.6 The Legal Warranty does not cover any defects caused by:
• Accidental factors.
• Customer liability or use of the Product that is not in accordance with its intended use and/or as provided in the instructions for use.
• The use of perfumes, detergents, or essential oils that may cause premature wear of elastic bands and threads, as well as discoloration of the plating or discoloration of natural stones or beads in the product.
• Natural aging and wear of the materials that compose the entire product.
• Minor manufacturing imperfections as indicated in section 6.3 of this policy.
13.7 In the event that a Product exhibits what may be a defect during the validity period of the Legal Guarantee, the customer must promptly notify the seller by email. The seller will promptly respond to the notification of the alleged defect and will indicate the specific procedure to follow. If the defect is confirmed, the customer will have the right to free repair and/or replacement of the item.
14. Applicable law and competent court
14.1 For a more rapid resolution, the Customer may contact the Owner directly by email: info@wildandinspire.com who will attempt to resolve the issue as best as possible.
14.2 Contracts concluded between users of the Site and the Owner are governed by Italian law. This does not affect the application of any more favorable and mandatory provisions of the law of the country in which they have their habitual residence to consumers who do not have their habitual residence in Italy, particularly with regard to the deadline for exercising the right of withdrawal, the deadline for returning Products in the event of exercising this right, the methods and formalities for communicating this right, and the legal guarantee of conformity.
14.3 Please note that for consumers, any disputes relating to the application, execution, and interpretation of these General Terms and Conditions of Sale shall be subject to the jurisdiction of the court of the place where the consumer resides or has elected domicile.
14.4 If the consumer has submitted a complaint directly to the Owner, but it has not been possible to resolve the dispute, the consumer may refer the matter to the EU online dispute resolution platform (the "ODR platform"). The ODR platform offers consumers and professionals within the EU the opportunity to reach an out-of-court resolution for complaints related to online purchases. By using the ODR platform, the end consumer and the professional can contact a dispute resolution body and then attempt to resolve the consumer's dispute.
